Two police officers driving to work spotted a man standing at a bus stop with his trousers down and scratching his private parts.
Tomasz Fudalej – who said he suffered “dermatitis in the genital area” – was seen at 6am on a Sunday morning.
Three shift workers who also passed him turned the car round to confirm what they had seen. Fudalej was arrested and taken to Livingston Police Station, where a doctor confirmed that he was suffering from a skin complaint.
The 25-year-old was originally charged with a sexual offence which would have seen his name being added to the Sex Offenders’ Register.
But at Livingston Sheriff Court on Wednesday he pleaded guilty to a lesser charge of committing an offence of public indecency on the A899 on August 4 last year.
Alan Jackson, defending, said: “He didn’t particularly mean to cause offence and there is no suggestion that there was any eye contact with anyone.”
Fudalej was fined £225.
