A teenager who raped a drunken 12-year-old girl just 10 days after he sexually abused a teenager has escaped being sent to prison.

Aaron Ross was just 14-years-old when he subjected the girl to a serious sexual assault in Musselburgh in August 2012.

The High Court in Edinburgh heard that Ross - who turned 16 last month - had indecently also assaulted a 13-year-old girl at a primary school in the town.

The story emerged when Ross was convicted of sexual assault and rape following a trial at the High Court in Edinburgh last year.

Sentence had been deferred in order for the court to obtain reports.

But following a hearing today judge Lady Clark heard how Ross was a vulnerable individual with a mental age far younger than his actual one.

The judge also told Ross that she didn’t want to send him to a young offenders institution because she feared he could spend time with hardened criminals.

Lady Clark feared this could stop him from being rehabilitated and turn him to a life of crime.

Now Ross will return to the High Court next week and receive a community based sentence.
