Man jailed for throwing toilet cistern out top-floor window

A 33-YEAR-OLD man, who threw objects ranging from eggs to radiators and a toilet cistern from a tenement top floor window into a beer garden and street below, has been jailed for 17 months.

Scott Warren was told by Sheriff John Beckett QC at Edinburgh Sheriff Court today: “Sort yourself out, because you could kill somebody if you do this again”.

Warren, who lived in Blackfriars Street in the city, had pled guilty previously to charges of culpable and reckless conduct between September 25 and October 19 last year.

On the morning of September 26, the owner of the Blackfriars Bar and Grill found the beer garden at rear of the premises covered in rubbish, including glass jars and eggs. They had been thrown from a rear window of Warren’s flat during the night. On October 1, police officers went to Warren’s flat to speak to him about the incident. Fiscal Depute, Aidan Higgins, told Sheriff Beckett: “He (Warren) was agitated. He became angry and picked up a printer and made to throw it out of the top-floor window. It was blocked by one of the officers and Warren began shouting, saying ‘This is f.....g rubbish. Send me to prison. I have had enough of this s..t”.

On October 12, Warren threw radiators into the street, denting and scratching a Vauxhall Corsa car which was parked there. Later that night, Warren threw a toilet cistern into the beer garden at the rear of the bar. On the afternoon of October 19, the owner of the bar heard the sound of items hitting the ground in the beer garden. They were light fittings thrown from Warren’s rear window. The court heard that, fortunately, there had been no people in the beer garden when items were thrown.

Defence solicitor, Mark Hutchison said his client suffered from Aspergers Syndrome and mood swings. Mr Hutchison told Sheriff Beckett: “Usually you get reports which say something positive, but the best that can be said about Mr Warren is he pled guilty to the offences”.

Sheriff Beckett told Warren: “Because of the nature and seriousness of these offences you have reached the point where there is no alternative, but a prison sentence. I hope learn a lesson from this, because if you don’t you will spend a very long time in prison”.
