Viral infection brings rape trial to a halt

A RAPE trial has been abandoned after the alleged victim contracted a viral infection.

Lord Turnbull terminated proceedings at the High Court in Livingston, and discharged the jury.

The accused, Scott Main, from Livingston, denies raping the girl beside a footpath in the Howden area of the town on March 16, 2012. He will now be tried by a fresh jury later this year.

The case against Main, 19, had to be adjourned on Monday when the 15-year-old girl he allegedly attacked failed to turn up at court.

Lord Turnbull said yesterday that the key prosecution witness had been diagnosed with a viral infection which could spread to other people.

He said: “The doctor has explained that, in her view, there’s a risk that the young lady might have some form of contagious illness. The doctor’s view is that she shouldn’t come to court.”

The Crown formally deserted the case for the time being and the judge ordered the 
proceedings to be terminated.
