A JUDGE has agreed to place all five men staying in a Benidorm holiday apartment from which a Lothian woman fell to her death under formal investigation.
Kirsty Maxwell, from Livingston, died last month after falling from a tenth-storey apartment she is believed to have entered by mistake.
The 27-year-old, who married husband Adam in September, had been on a hen party.
Judge Ana Isabel Garcia-Galbis today said she wanted to question the men – who are all understood to be British – on July 26 at 11am. The court session will take place behind closed doors and will not be open to the press or public.
Maxwell family lawyer Luis Miguel Zumaquero said after the hearing: “We have managed to get a foot in the door and it’s now going to be difficult to close that door.
“But it doesn’t mean that we have achieved our objective.
“There’s a long road ahead but we’ve taken an important first step.
“Kirsty’s family know about this decision and they have obviously welcomed it.”
Mr Maxwell said previously: “Kirsty was happy and healthy and had everything to live for.
“It’s crazy to suggest she killed herself.”
